Privacy policy

**SPIRITHAUS PTY LTD** (ABN 97 701 853 483) trades as SPIRITHAUS at spirithaus.com.au under NSW packaged liquor licence **LIQP700301260**. This policy explains what personal information we collect, why, and what you can do about it. It follows the Australian Privacy Principles in the *Privacy Act 1988* (Cth).

Questions, corrections or complaints: **sales@spirithaus.com.au**.

## What we collect

**When you order.** Your name, delivery address, email address, phone number and what you bought. Payment is taken by Shopify Payments — **we never see or store your full card number.**

**When you join the Cellar Club.** Your email address, your first name if you give it, and the fact that you confirmed you are 18 or over and agreed to receive email from us.

**When you browse.** Standard web information — pages viewed, device and browser type, and an approximate location from your IP address. Our platform, Shopify, sets cookies that keep your cart working and let us understand how the site is used.

**Age.** We ask you to confirm you are 18 or over. We are legally required to be satisfied of this before selling alcohol, and our driver checks photo ID on delivery.

## Why we collect it

- To take, pack, deliver and if necessary refund your order.
- To meet our obligations as a NSW liquor licensee, including age verification and record keeping.
- To send you the emails you asked for, if you asked for them.
- To keep the site working, secure and comprehensible to us.

**We do not sell your personal information to anybody, ever.**

## Marketing, and how to stop it

We email you about new arrivals and member pricing **only if you ticked the box asking us to.** Every email identifies us and carries a working unsubscribe link, and unsubscribing takes effect immediately. That is what the *Spam Act 2003* requires and we would rather do it properly than argue about it.

Unsubscribing from marketing does not stop the emails about an order you have placed — you will still get a confirmation and a dispatch notice.

## Who else sees it

Only the people who have to:

- **Shopify**, which hosts the store, takes the payment through Shopify Payments, and sends our order and marketing emails.
- **Microsoft**, which runs the mailbox behind sales@spirithaus.com.au — so anything you write to us, and anything we write back, sits there.
- A regulator, a court or the police where the law requires it.

That is the whole list. **We deliver with our own driver**, so your address does not go to a courier, and we do not sell, rent or trade your details to anybody.

## Where it is held

Both are overseas companies and both may hold your information outside Australia.

Shopify is Canadian, and publishes the full list of the providers it uses and where they operate at [help.shopify.com/en/manual/privacy-and-security/privacy/subprocessors](https://help.shopify.com/en/manual/privacy-and-security/privacy/subprocessors). Microsoft is American, and publishes where it stores data at [microsoft.com/trust-center](https://www.microsoft.com/trust-center).

Both lists are kept current at those links rather than copied out here, where they would quietly go out of date.

By giving us your details you consent to them being handled this way. If you would rather they were not, we cannot take your order — everything above is how the shop runs, not an optional extra.

## How long we keep it

Order records are kept for **5 years**, because tax and liquor licensing record-keeping obligations require it. Club list data is kept until you unsubscribe, and then removed from the active list.

## Keeping it safe

The site runs over HTTPS and access to customer data is limited to people who need it to do their job. No system is perfect; if a breach occurs that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner, as the Notifiable Data Breaches scheme requires.

## Your rights

You can ask us for a copy of the personal information we hold about you, ask us to correct it, or ask us to delete it. Write to **sales@spirithaus.com.au** and we will respond within **30 days**.

We may not be able to delete everything — order records we are legally required to keep will stay until that period expires, and we will tell you if that is the case.

If you are unhappy with how we have handled your information, you can complain to us first, and then to the Office of the Australian Information Commissioner at **oaic.gov.au** or **1300 363 992**.

## Changes

If this policy changes we will post the new version here and update the date below. Material changes to how we use your information will be notified to club members by email.
