Terms of sale

These terms apply to every order placed at spirithaus.com.au. Placing an order means you accept them.

The seller is **SPIRITHAUS PTY LTD**, ABN 97 701 853 483 (ACN 701 853 483), holder of NSW packaged liquor licence **LIQP700301260**.

## You must be 18

**It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years.**

By ordering you confirm that you are 18 or over, and that the person receiving the order is 18 or over. We check photo ID on delivery and our driver will refuse to hand over an order to anyone who cannot produce it, or who appears intoxicated. Refused orders return to us — see [Returns and refunds](/pages/returns).

Supplying false information about your age to obtain alcohol is an offence.

## Prices

All prices are in **Australian dollars and include GST**. Delivery is charged separately and shown before you pay.

We try hard to keep prices right. If a product is listed at an obviously wrong price — a decimal in the wrong place, a $200 bottle at $20 — we will contact you and either cancel and refund the order or confirm it at the correct price. We will not simply charge you more without asking.

## Your order is an offer

Adding to cart and paying is an offer to buy. The contract forms when we **dispatch** the order, not when you pay. If we cannot supply something we will tell you and refund that item in full.

We may refuse or cancel an order where we reasonably believe it is for someone under 18, for resale, or where the delivery address is outside our area.

## Stock

We buy small and some lines are very limited. Where we cannot fill an order we refund rather than substitute, unless you have asked us to substitute.

See [Delivery areas and times](/pages/delivery). Delivery windows are estimates and not guarantees; we will tell you as soon as we know if something is running late.

Risk in the goods passes to you when they are handed to you or to someone at your address who is 18 or over.

## Responsible service

We are a licensed retailer and we take it seriously. We will not sell to someone who is intoxicated, will not deliver to a person who appears intoxicated, and will not accept orders we believe are being placed for a minor. ## Content on this site

Tasting notes, product descriptions and the reason we stock each bottle are written by us and are our copyright. Product images belong to us or to the producer. Please do not reproduce them commercially.

We describe what is in the bottle as accurately as we can. **Alcohol strength and standard drink figures come from the producer or the label**; if you find one that does not match the bottle in your hand, tell us and we will correct it.

## Liability

Nothing here excludes any right you have under the Australian Consumer Law. Beyond those rights, our liability for any order is limited to the amount you paid for it.

## Governing law

The law of New South Wales, Australia.
